الملخص
تركز هذه الدراسة على مسألة تحديد المناطق البحرية كما جاءت به إتفاقية القانون الدولي للبحار، أو ما تُعرف باتفاقية "مونتيقو باي" لسنة 1982، وإشكالية العدالة والإنصاف المطروحة جرّاء هذا التقسيم، لاسيما ما بين الدول الساحلية وغير الساحلية أو ما يُعرف بالدول الحبيسة وتلك المتضررة جغرافيا. كما وتهدف هذه الدراسة إلى تسليط الضوء على المناطق البحرية كما أقرّتها اتفاقية القانون الدولي للبحار، وتقصي الصلاحيات والاختصاصات الممنوحة للدول الساحلية على هذه المناطق. Abstract: This study focuses on determination of maritime zones as it is mentioned in the law of the Sea Convention UNCLOS 1982, famously called Montego Bay Convention, and the equity problematic resulted from this determination, especially between coastal countries and landlocked countries. The main aim of this study is to spot light on maritime zones as it is determined in Montego Bay Convention of the problematic above mentioned, and to try to investigates the powers and competencies granted to coastal states over these areas.
