ضمانات الاستثمار الأجنبي المباشر في الاتفاقيات الدولية الثنائية للاستثمار كعامل من عوامل تحسين مناخ الاستثمار في الجزائر

الملخص
يقصد بمناخ الاستثمار، حسب تقرير مناخ الاستثمار في الدول العربية، مجمل الأوضاع والظروف الاقتصادية، الاجتماعية، السياسية، المؤسسية والقانونية التي يمكن أن تؤثر على قرار الاستثمار وعلى فرص نجاح المشروع الاستثماري في دولة ما أو قطاع معين. ويؤثر الإطار القانوني للبلاد تأثيرا كبيرا على اتخاذ قرار الاستثمار بالنسبة للشركات الأجنبية، حيث يتراجع المستثمر عن دخول للاستثمار إذا رأى أن القانون الداخلي لا يوفر له ضمانات كافية، ولكن ما يلاحظ أن البلاد عرفت عدة استثمارات لرعاية أجانب تابعين لدول أبرمت معها الجزائر اتفاقية ثنائية لتشجيع وحماية الاستثمارات، ويظهر من خلال هذه الاتفاقيات أنها تشكل إطارا قانونيا يستعين بها المستثمر الأجنبي في اتخاذ قرار الاستثمار نظرا لضمانات التي توفرها، ويعد هذا الإطار مؤشرا من شأنه تحسين مناخ الاستثمار في الجزائر. Abstract: The investment climate, according to the Investment Climate Report in the Arab Countries, means the aggregate economic, social, political, institutional and legal conditions and conditions that can affect the investment decision and the chances of success of the investment project in a country or a specific sector. The legal framework of the country greatly affects investment decision-making for foreign companies, as the investor retracts an investment if he sees that the internal law does not provide him with adequate guarantees, but what is observed is that the Algeria has known several investments foreigners are coming of a countries with which Algeria has concluded a bilateral agreement (convention) to encourage and protect Investments. And it appears through these agreements that they constitute a legal framework used by the foreign investor to make the investment decision in view of the guarantees that they provide. This framework is an indicator that will improve the investment climate in Algeria.
