استقلالية وخصوصية القضاء الإداري بين الواقع والقانون (دراسة على ضوء التشريع الجزائري)

الملخص
من بين أهم المبادئ التي يقوم عليها التنظيم القضائي الجزائري مبدأ " استقلالية القضاء"، والذي يعد من أهم المبادئ الجوهرية التي ترتكز عليها دولة القانون، ذلك أنه يرسخ ثقة المواطنين في مؤسسات الدولة، وهذا ما نادت به جل المواثيق الدولية والاقليمية. وهو نفس ما تبناه المؤسس الدستوري والمشرع الجزائري صراحة عند الأخذ بمبدأ الازدواجية القضائية تأثرا منه بالمنظومة القانونية الفرنسية، ليمنح للقاضي الإداري دورا أساسيا لتكريس دولة القانون، حيث يتمتع بنظام قانوني خاص .يضمن استقلاليته العضوية عن باقي السلطات، كما خصه بعدة اختصاصات حصرية نظرا لخصوصية المنازعات الإدارية والإجراءات التي تحكمها Among the most important principles on which the Algerian judicial Organization is based on the principle of " independence of the judiciary", which is one of the most fundamental principles on which the rule of law is based on, as it establishes the Confidence of citizens in state institutions, which called for by most of the international and regional covenants. It is the same thing that the Algerian constitutional founder and legislator explicitly adopted when adopting the principle of judicial, influenced by the French legal system, by giving the Administrative judge a fundamental role to perpetuate the state of law, as he has a special legal system that guarantees his organic independence from the rest of the authorities, and he also has several exclusive powers, in view for the privacy of administrative disputes and the procedures that govern them.
