مقاربة ما بعد وضعية لأشكال القانون في المجتمع المعاصر

الملخص
الملخص يهدف هذا البحث إلى محاولة إدراك العلاقة بين القانون والحوكمة في عصر العولمة وفق الشروط الجديدة التي توفّرها التطوُّرات السياسية، الاقتصادية، الاجتماعية والثقافية الراهنة. وبناءا على ذلك سوف نقوم بكشف التحوُّلات التي طرأت على مفهوم الحوكمة وانتقاله من المستويات الدولاتية الوطنية الدولية إلى المستويات العالمية المجتمعية، وتداعيات ذلك على الترتيبات القانونية الناشئة والمحددات الأساسية لمفهوم القانون غير الدولاتي. إن معرفة الترتيبات القانونية المعاصرة تحيلنا إلى تحليل العلاقات المتبادلة بين الحكم العالمي والقانون وذلك من خلال جانبين أولهما، تأثيرات القانون في الحوكمة العالمية وهو ما يُنتج ترتيبات قانونية جديدة في شكل تجزؤ أو تهجين للقانون، ثانيا، تأثيرات الحوكمة العالمية في القانون وهو ما ينتج ترتيبات قانونية جديدة أيضا في شكل ترتيبات شمولية جديدة أو نشاط خارج القانون. Résumé Le but de cette recherche est de comprendre la relation entre le droit et la gouvernance à l'ère de la mondialisation dans les conditions des développements politiques, économiques, sociaux et culturels. Pour cela, nous allons montrer les transformations de la notion de gouvernance des notions étatiques internationales vers l’espace transnational sociétal, et les implications pour les configurations juridiques émergentes et les déterminants sous-jacents de la notion de droit non-étatique. La connaissance des configurations juridiques contemporaines permet d’analyser les interrelations entre la gouvernance mondiale et le droit à partir des effets du droit sur la gouvernance mondiale, et qui produit la fragmentation ou l'hybridation du droit, et des effets de la gouvernance mondiale sur le droit qui produit l’activisme hors droit ou des configurations néo-totalitaires. Summary The aim of this article is to provide perceptions of the relationship between law and governance in the age of globalization, based on the contemporary political, economic, social and cultural transformations. To do so, the researcher will demonstrate the transformations of governance from statist and international to global and societal levels, the implications of these transformations on legal configurations, and the basic features of the concept of non-state law. Understanding contemporary legal configurations paves the way to analyzing the relationship between global governance and law through the influence of law on global governance that produces the fragmentation or hybridization of law, and the influence of global governance on law that can be in the form of neo-totalitarian arrangements or extra-legal activism.
