تفويض المرفق العام مفهومه، أسسه، أشكاله، في ظل المرسوم التنفيذي 18/199

الملخص
يتولى المرفق العام تقديم خدمات للمواطنين أو تلبية لحاجاتهم تحقيقا للمصلحة العامة، وبما أن الحاجيات تتطور بتطور المجتمع فوجب على المرافق العامة مواكبة هذا التطور، لاسيما طرق تسييره، خاصة بعد عجز الطرق التقليدية للتسيير، (الاستغلال المباشر، المؤسسة العامة)، وذلك بسبب تطور الحياة الاقتصادية ونمو الوعي المدني، إضافة إلى تخلي الدولة من بسط يدها على المرافق الاقتصادية، مما استدعى البحث عن بدائل لتسيير المرافق تمثلت في آلية تفويض المرفق العام، والتي أخذت مكانتها كمفهوم عام يضم عدد من العقود ( الامتياز، الإيجار، الوكالة المحفزة، التسيير)، والتي تسند إلى أشخاص عامة أو خاصة تسيير مرفق عام، وهذا ما تجلى في المرسوم الرئاسي 15/247، والمرسوم التنفيذي 18/199 الذي جاء تطبيقا له. That is due to the development of the Economy and the growth of civil awareness, in addition to the state relinquishing control over economic facilities, which required alternatives to operate them represented in the mechanism of delegation of the public facility, which took its place as a general concept that includes a number of contracts (concession, rent, incentive agency, management), which are assigned to public or private entities in the conduct of facility, and this is reflected in the Presidential Decree 15/247, the Executive Decree 18/199, which was applied to him.
