العلاقة بين السلطتين التشريعية والتنفيذية في مجال إدارة العلاقات الخارجية

الملخص

الملخص منح الدستور الجزائري الصادر سنة 1989 ،المعدل سنوات 1996، 2002 و 2008، للسلطة التشريعية دورا محدودا جدا في مجال إدارة العلاقات الخارجية للدولة. فقد أوكل الدستور هذه المهمة إلى السلطة التنفيذية مجسدة في رئيس الجمهورية. وسنحاول في هذه الدراسة: أولا، توضيح هذا الدور من خلال تسليط الضوء على مدى سلطة الجهاز التشريعي في نصح رئيس الجمهورية حول السياسة الخارجية وممارسة نوعا من الرقابة عليه عند إبرامه للمعاهدات الدولية أو إبطالها استنادا إلى عدم دستوريتها، وثانيا تقويم ذلك الدور ثم تقديم بعض الاقتراحات المتواضعة. ونود الإشارة إلى أننا نحاول إجراء مقارنة بين مختلف النصوص المتعلقة بالموضوع التي تضمنتها الدساتير الجزائرية المتعاقبة رغم أن الحديث عن «العلاقة بين السلطات» غير دقيق قبل دستور 1989 بسبب اعتماد الدستور الذي سبقه مفهوم العلاقة بين «الوظائف»1 فالغرض من المقارنة إذن هو محاولة الإلمام بالموضوع بصورة أفضل. Resume La Constitution algérienne de 1989, comme elle a été modifiée en 1996,2002 et 2008, a octroyé au pouvoir législatif un rôle très limité dans la direction des relations externes de l'Etat. Elle a confié cette tâche au pouvoir exécutif, concrétisé en la personne du président. Nous allons essayer dans cet article:, de clarifier d'abord ce rôle, en mettant en évidence l'ampleur du pouvoir du parlement de conseiller le président sur la politique étrangère et l’ exercice d'une sorte de contrôle en la matière de la conclusion de traités internationaux ou sa révocation sur la base d’inconstitutionnalité ; et d'autre part évaluer ce rôle, pour présenter quelques suggestions modestes. Nous tenons à souligner que nous essayerons de faire une comparaison entre les différents textes pertinents inclus dans les constitutions successives algériennes, Bien que parler de «relation entre les pouvoirs» est inexacte avant la Constitution de 1989, qui a été précédée par le concept de la relation entre les «fonctions». Le but de la comparaison est donc une tentative d’offrir une meilleure connaissance du sujet. Summary The Algerian Constitution of 1989, as amended in 1996.2002 and 2008, granted the Parliament very limited role in the direction of external relations of the State. The Constitution has entrusted this task to the executive power as reflected in the President. I will try in this study: first, to clarify this role by highlighting the extent of the parliament power to advise the President on foreign policy, to exercise of some sort of control over the conclusion of international treaties, and to ask for its revocation on the basis of being unconstitutional. Secondly, to evaluate that role, and then offer some modest suggestions. I would like to note that I will try to make a comparison between the various relevant texts included in the Algerian successive constitutions concerning the relationship between the two powers although talk about “powers» is inaccurate before the adoption of 1989 Constitution due to the fact that the 1976 Constitution, uses the term “functions” instead of powers. The comparison may, thus, clarify better this subject
