إن فتح المشرع الجزائري المجال للتفاوض بشأن تنظيم العمل الليلي جعله يشكل تهديدًا للتوازن بين الأسرة والحياة المهنية للعمال ذوي المسؤوليات الأسريـــــــــــة من الجنسين ، سيما وأن الاتفاقيــــــــــات التي تنظم العمل الليلي لا تحتــــــــوي على أي تفاصيل عن الشروط أو الحقوق المرتبطـــــة به ، ناهيك عن تنظيمه أحيانـــــــــــــــا بموجب الأنظمة الداخلية للمؤسسات في غيــــــــــــــــاب نص تشريعي واضح ودقيق.
