Résumé
تعتبر الواحات الصحراوية عنصرا أساسيا هاما ساهم في استقرار الانسان منذ القدم في الصحراء ذات العوامل الطبيعية القاسية، فقد كانت بمثابة الحياة المناسبة له، إذ منها كان يضمن قوته اليومي ويلبي حاجياته الضرورية، ولشدّة قربه منها تجلت مكانتها في صناعة الحياة لدى الانسان في الوسيط العميق للصحراء. و من هذا تأتي اشكالية دراستنا هذه التي تسلط الضوء على نمط قانون الماء و الملكية العقارية الذي فرض سلطانه عند سكان الواحات منذ القدم في تسيير الجانب الزراعي و الذي لا يقبل بتاتا التنازل عليه و كذلك موقف التشريع الجزائري الذي يحاول دوما إيجاد التوازن بين ما هو تقليدي و حديث في منطقة الواحات الجزائرية و ذلك من أجل الحفاظ على استقرار سكان الواحات بموطنهم الأصلي مع إدخال نوع من الاصلاح في المجال الفلاحي معتمدا على تقنيات حديثة في مجال استغلال .الماء و تعيين الملكية العقارية التي لا زالت تفتقد عنصر الاثبات في هذه المناطق ، و كلّ هذا سوف يساعد سكان الواحات على الاكتفاء الذاتي من جهة و التصدير إلى المناطق الشمالية من جهة أخر The desert oases are considered an important basic element that contributed to the stability of man since ancient times in the desert with harsh natural factors. From this comes the problematic of our study, which sheds light on the pattern of water law and real estate ownership, which imposed its authority on the inhabitants of the oases since ancient times in the management of the agricultural side, which is absolutely not accepting to concede it, as well as the position of Algerian legislation that always tries to find a balance between what is traditional And a conversation in the Algerian region of oases in order to preserve the stability of the oasis residents in their original homeland with Introducing some kind of reform in the agricultural field based on modern technologies in the field of water exploitation and the designation of real estate ownership that still lacks the element of proof in these areas, and all this will help the inhabitants of the oases to become self-sufficient on the one hand and export to the northern regions on the other hand.
