التنمية الاجتماعية محدد تشريعي لازم للصفقة العمومية

الملخص
تتناول الدراسة توضيح مدى مساهمة الصفقات العمومية في تحقيق متطلبات التنمية الاجتماعية، على اعتبار أن أحكام مدونة العمل تندرج ضمن أبعاد المصلحة العامة، و من أجل تكريس حقوق العامل في الصفقات العمومية تعين بالضرورة على المشرع إعمال آليات قانونية و أحكام قانونية آمرة من شأنها المحافظة على حقوق الطبقة العاملة. وعلى قاعدة القانون التي تعتبر الفيصل بين المتنافسين و بينهم و بين المصلحة المتعاقدة المساهمة في تعزيز و تجسيد مقتضيات التنمية الاجتماعية من خلال إقصاء كل متعامل اقتصادي يتجاهل أحكام مدونة العمل والتحقق من صحة الوثائق المطلوبة في هذا الشأن، خاصة أن الواقع العملي أظهر في حالات كثيرة، عدم التزام المتعامل المتعاقد في الجزائر بالمقتضيات القانونية الخاصة ببيئة العمل و التي أعاقت بشكل أو بآخر التنمية الاجتماعية و الاقتصادية عن تحقيق غايتها. The study aims to clarify the extent to which public contracts contribute to the fulfillment of social development requirements, considering that the provisions of the Labor Code fall within the dimensions of the public interest, and to enshrine the rights of the worker in the markets public, the legislator must necessarily put in place legal mechanisms and imperative legal provisions which preserve the rights of the working class. And on the rule of law which is the distinction between competitors and between them and the contracting service contributing to the promotion and fulfillment of the requirements of social development by excluding any economic operator who ignores the provisions of the labor code and by verifying the validity of the documents required in this regard, especially as the practical reality has appeared in many cases Failure to oblige the contracting client in Algeria to the legal requirements related to the working environment, which has prevented in a way or another social and economic development to achieve its goal.
