الملخص
Abstract: Academics, researchers, institutions, and states have paid great attention to the family and paid great attention to it. The Muslim family has been subjected to misapplication by some Muslims and to a misunderstanding of Sharia texts. Certain traditions and customs which have been attached to the family and attributed to Islam and of which they are innocent have spread. . Those who observe all the conflicts leading to disagreements and then to the disintegration of the family will find that they are the result of a failure to exercise their rights and their duties. If everyone fulfilled their duties and respected the rights of the other party, we would not have come to where we are today. So, what are the most appropriate and best ways to manage a family away from conflicts and disagreements that lead to family breakdown? ملخص: لقد اهتم العلماء والباحثون والمؤسسات والدول بالأسرة وأولوها اهتماما كبيرا ولقد تعرضت الأسرة المسلمة لسوء تطبيق من بعض المسلمين ولسوء الفهم للنصوص الشرعية فانتشرت بعض التقاليد والعادات التي ألحقت بالأسرة ونسبت إلى الإسلام وهو منها بريء، إذ العيب ليس في النصوص الشرعية وإنما في سوء تطبيقها من طرف منتسبيها. والمتتبع لجملة النزاعات المؤدية إلى الخلاف ومن ثم إلى التفكك الأسري يجد أنها ناتجة عن عدم أداء الحقوق وتحمل الواجبات فلو أدى كل واحد ما عليه من واجبات واحترام حقوق الطرف الأخر لما وصلنا إلى ما نحن عليه اليوم. فما هي الطرق الأنسب والأفضل لإدارة أسرة بعيدا عن النزاعات والخلافات المفضية إلى التفكك الأسري؟ Résumé : Les universitaires, les chercheurs, les institutions et les États ont accordé une grande attention à la famille et y ont prêté une grande attention. La famille musulmane a été soumise à une mauvaise application par certains musulmans et à une incompréhension des textes de la charia. Certaines traditions et coutumes qui ont été attachées à la famille et attribuées à l'islam et dont elles sont innocentes se sont répandues. . Ceux qui observent l'ensemble des conflits menant à des désaccords puis à la désintégration de la famille constateront qu'ils sont le résultat d'un manquement à l'exercice de ses droits et à ses devoirs. Si chacun accomplissait ses devoirs et respectait les droits de l'autre partie, nous ne serions pas arrivés là où nous en sommes aujourd'hui. Alors, quels sont les moyens les plus appropriés et les meilleurs pour gérer une famille loin des conflits et des désaccords qui conduisent à la rupture familiale ?
