مبررات تدخل الأداة الجنائية في مجال حقوق التأليف

الملخص
تحتل حقوق المؤلف مكانة هامة في المجتمع الحديث ليس باعتبارها أداة للإرتقاء الإجتماعي، وإنما باعتبار المجتمع الحديث هو مجتمع معلومات يستهلك بصفة أساسية عناصر الملكية الفكرية بما فيها حقوق المؤلف والحقوق المجاورة لحق المؤلف ، خاصة ما لم يتم تداوله عبر المواقع الالكترونية لشبكة الانترنت .كما يشهد عالم اليوم نوعا جديدا من الاقتصاد يعرف باقتصاد المعرفة تحتل فيه عناصر الملكية الفكرية و حقوق المؤلف نسبة تفوق 90 % من التبادلات التجارية لذلك عززت الاتفاقيات الدولية والتشريعات الوطنية هذه الحقوق بنصوص جنائية لردع كل من تسول له نفسه المساس بها ،والحماية الجنائية لحقوق المؤلف ليست وليدة العصر الحديث أو ما تتطلبه نتائج التكنولوجيات المعلوماتية من قواعد صارمة ، وإنما تمتد جذورها إلى بدايات تنظيم حقوق المؤلف .لذلك لا بد من البحث في المبررات المنطقية لتدخل القانون الجنائي في مجال حقوق التأليف الذي يعد من صميم موضوعات القانون الخاص . Abstract: Copyright occupies an important place in modern society not as a tool for social advancement, but as a modern society is an information society that mainly consumes elements of intellectual property, including copyright and rights related to copyright, especially if it is not circulated through websites on the Internet. Today’s world is also witnessing a new type of economy known as a knowledge economy in which the elements of intellectual property and copyright occupy more than 90% of commercial exchanges. Therefore, international agreements and national legislations have strengthened these rights with criminal provisions to deter anyone who is tempted to violate them, and criminal protection for copyright is not The new era or the strict rules required by the results of information technologies, but its roots extend to the beginnings of copyright regulation. Therefore, it is imperative to research the rationale for criminal law intervention in the copyright field, which is one of the core issues of private law.
