إصلاح التشريعات الضامنة للإختيار الأمثل للنظام الإنتخابي

الملخص
تعد الانتخابات الحرة والنزيهة أحد أهم العناصر المميزة للنظام الديمقراطي ، كونها الوسيلة الأساسية لإسناد السلطة في الحياة الديمقراطية المعاصرة ، ولايمكن إجراءالانتخابات بدون وجود قانون إنتخابي يحدد مسارها ، ويعد النظام الإنتخابي من أهم وأكثر أجزاء القانون الإنتخابي أهمية إنطلاقاً من إن لكل نظام إنتخابي خصائص تميزه عن الآخر و له سلبياته أيضاً ، لذلك فإن تبني نوع معين من الأنظمة الانتخابية لايمكن أن يكون إعتباطاً وإنما نتيجة تظافر مجموعة عوامل منها السياسية والدينية والإجتماعية والثقافية والخارجية أيضاً للدولة المعنية ، وكذلك لما للنظام الإنتخابي من آثار عدة تبدو واضحة بعد إعلان نتائج الانتخابات ، فهو يحدد حجم الأحزاب السياسية المشاركة في العملية الانتخابية ، وتنعكس نتائجه في النهاية على أداء البرلمان والحكومة في تلبية تطلعات الناخبين ، وتستهدف هذه الدراسة الخوض في عمق الأنظمة الانتخابية ، ومن ثم بيان السياق للأنظمة الانتخابية في الانتخابات البرلمانية العراقية ، ومدى تأثيرها على الحياة السياسية. Abstract: Free and fair elections are one of the most important elements of a democratic regime, for being a fundamental tool to assign authority in contemporary democratic life. Elections cannot be held without an electoral law that defines its course. Electoral system is considered as one of the most important component of the electoral law, due to the fact that each electoral system has characteristics that distinguish it from the others, beside its drawbacks. Therefore, the adoption of a specific form of electoral systems should not be based on an arbitrary measure, but rather derived from a combination of political, religious, social, cultural and foreign factors in a certain country. Also, due to the impacts of the electoral system that revealed after the announcement of the election results, as it identifies the size of the political parties participating in the electoral process, and ultimately, its results are reflected on the performance of the parliament and government in meeting voters’ aspirations. This study aims to thoroughly examine electoral systems, and then clarify the context of the electoral systems in the Iraqi parliamentary elections, and the extent of their impact on political life.
