تأديب الزوجة ، حق مشروع أم إنتهاك محظور؟

الملخص
الأصل في الحياة الزوجية أن تقوم على المودة والاحترام بين كلا من الزوجين وهذا في ظل مبدأ الطاعة الواجبة من الزوجة لزوجها باعتباره سيد الأسرة وراعيها مما يعطي للزوج الحق في التصرف والتدبير وحتى التأديب إذا وقع ما يخل بالاستقرار الأسري كحالة نشوز الزوجة . غير أن الإشكال لا يثور من الناحية الشرعية ، حيث يعد التأديب حقا للزوج حال قيام دواعيه وأسبابه ومتى توفرت شروطه وضوابطه الشرعية . في حين أن الإشكال عالق في القوانين الوضعية فالقانون الجنائي وعلى الرغم من اعتداده بالإباحة لأفعال تشكل في ظاهرها جرائم لانتفاء علة التجريم في ظروف معينة كاستعمال الحق ،غير أنه لا يعتد بذلك في الأفعال الناجمة عن استعمال حق الزوج في تأديبه لزوجته الناشز بالضرب . The fundament of marital life is that it is the affection and respect between the husband and the wife. according to the principle of obedience from the wife to her husband whereas the husband is the master of the family, so the husband has the right to act, manage and even discipline if something violates family stability such as the disobedience of the wife There is no problem according the view point of the religion, as the disciplining is a right of the husband wherever its motives and religious reasons are available. The problem is in the positive laws. For example the criminal law, allows some acts, in spite of its appearing as a crime in specific circumstances, due to the absence of the criminal causes in these circumstances. The criminal law does not consider that in using the husband’s right to discipline his wife by beating
