دور محكمة العدل الدولية في تفسير أو تطبيق الاتفاقية الدولية للقضاء على جميع أشكال التمييز العنصري

الملخص
تسعى هذه الدراسة إلى توضيح حدود وطبيعة العلاقة بين محكمة العدل الدولية بصفتها الجهاز القضائي الرئيسي للأمم المتحدة من جهة، والاتفاقية الدولية للقضاء على جميع أشكال التمييز العنصري كأحد أهم الاتفاقيات الدولية في مجال حقوق الانسان من جهة ثانية. وفي هذا الخصوص، تبين المادة 22 من ذات الاتفاقية الجانب النظري لحدود تلك العلاقة والشروط المرتبطة بها، في حين تكشف بعض القضايا التي أحيلت على المحكمة الجانب العملي في تفسير أو تطبيق الاتفاقية الدولية للقضاء على جميع أشكال التمييز العنصري والتي كان آخرها سنة 2018 بين قطر والإمارات العربية المتحدة. This study seeks to clarify the limits and nature of the relationship between the International Court of Justice as the main judicial organ of the United Nations on the one hand, and the International Convention on the elimination of all forms of Racial discrimination, as it represents one of the most important international conventions in the field of human rights on the other hand. In this respect, the article 22 of the same agreement demonstrates the theoretical side of the limits of that relationship and the conditions attached to it, whereas some cases which were referred to the court revealed the practical side in interpreting or applying the International Convention on the elimination of All forms of racial discrimination, the last of which was in 2018 between Qatar and the United Arab Emirates.
