الملخص

تشكل المحكمة الجنائية الدولية الدعامة الأساسية في ضمان عدم إفلات مرتكبي الجرائم الأشدّ خطورة من العقاب، وبذلك تساهم المحكمة في تحقيق الغاية الأساسية التي نص عليها ميثاق الأمم المتحدة، وهي تعزيز حقوق الإنسان، إلاّ أن تأثير مجلس الأمن (جهاز سياسي) على اختصاص المحكمة (جهاز قضائي) يجعلها تصطدم بضرورات حفظ السلم والأمن الدوليين المقرر، والمكيف وفقا لإرادة الأعضاء الدائمين، لاسيما وأن عملية تحديد وقوع العدوان اختصاص أصيل لمجلس الأمن. The International Criminal Court is the mainstay in ensuring that perpetrators of the most serious crimes do not go unpunished, and in this way the court contributes to achieving the primary goal stipulated in the United Nations Charter, which is the promotion of human rights, but the impact of the Security Council ( a political body) on the jurisdiction of the court (a judicial body) makes it clash with the imperatives of maintaining international peace and security, which is determined and adapted to the will of the permanent members, especially since the process of determining the occurrence of aggression is an inherent jurisdiction of the Security Council.
