سلطة الولي في إجراء التصرفات العقارية دراسة مقارنة في التشريعات العراقية The Guardian's Authority To Conduct Real Estate Actions A Comparative Study In Iraqi Legislations

الملخص
يتناول هذا البحث سلطات الولي في إجراء التصرفات العقارية في التشريعات العراقية. والغرض منه هو بيان هذه السلطات بالتفصيل، بهدف إزالة ورفع الغموض التي يعتريها. وفي سبيل تحقيق ذلك، استخدم الباحث المنهج الاستقرائي، التحليلي، المقارن، والنقدي. واختتم البحث بنتائج، منها: لا يزال الأب والوصي المختار يتمتّعان بسلطة التعاقد مع النفس، لا يزال الأب يحتفظ بسلطة إجراء التصرفات العقارية في أموال القاصر لكن بعد الأستئذان من الجهات المختصة، تجريد الجدّ من سلطاته بعد سلب الولاية منه، واعتبار مديرية رعاية القاصرين الجهة المختصة بصدور الأذونات بدلاً من المحكمة. Abstract This research deals with the guardian authorities to conduct real estate actions. Its purpose is to articulate these authorities in detail, with a view to removing and raising the ambiguity that prevails. In order to achieve this, the researcher used the inductive, analytical, comparative and monetary method. The research concluded with results, including: The father and the chosen trustee still have the authority to contract oneself, the father still retains the authority to conduct real estate actions in the funds of the minor, but after permission from the competent authorities, the grandfather stripped of his authorities after taking the guardianship away from him, and considering the Minors' Care Directorate is the competent authority to issue permissions instead of the court.
