استحداث آليات لحماية رضا المستهلك الالكتروني

الملخص
نظرا لقصور الأحكام العامة في القانون المدني عن احتواء ضوابط تنظيمية للمستجدات التي أفرزها التطور الهائل في وسائل التعاقد الإلكتروني، لجأ المشرع إلى اعتماد حلول ترقيعية تتمثل في التعديلات المتكررة وسن عدة قوانين خاصة تحمل في طياتها أحكاما هامة يمكن تعميمها بفرضها في كل العقود كآليات تحمي المستهلك في جميع تعاملاته التعاقدية. أفرز التعامل التعاقدي اختلالا في المراكز القانونية بين المستهلك والمهني، أدى إلى سعى المشرع لإعادة التوازن بتكريس الالتزام بالإعلام الإلكتروني على عاتق المهني ومطابقة المنتجات وتعزيز حق المستهلك في التروي والعدول، وهذا من شأنه إرساء مبادئ أساسية ضمن الأحكام العامة للقانون المدني ليواكب التطور السريع للتكنولوجيا من جهة وحركية التشريعات الدولية من جهة ثانية. Abstract Due to the lack of general provisions in the civil code law to contain regulatory controls for the developments resulting from this tremendous development in electronic contracting means, the legislator has resorted to the adopting immediate solutions in repeated in repeated amendments and enacting many special laws that contain important provisions that can be generalized by imposing them in all contracts as mechanisms it protects the consumer in all contractual dealings. Contractual transactions led to an imbalance in the legal situation between the consumer and the professional, which prompted the legislator to seek to restore balance by devoting commitment to electronic media over the profession and matching the product and promoting the consumer’s right to think and return to the contact, and this would establish the basic principles within the general provisions of the civil law to keep pace the rapid development of technology on the one hand, and the movement of international legislation on the other.
