الاستدلال بإجماع أهل المدينة مقارنة بين المشارقة والمغاربة (العراق والأندلس) أنموذجا

الملخص
فكرة البحث تدور حول مدى فهم أصل من الأصول التي اعتمدها الإمام مالك رضي الله عنه في استنباط الأحكام، وهذا الأصل هو: عمل أهل المدينة، ومدى استيعاب تلاميذ المدرسة المالكية لهذا الأصل وفهم أقوال الإمام مالك رضي الله عنه وتخريج الفروع وتنزيل الوقائع على هذا الأصل، وكان المحال التطبيقي في المدرستين المدرسة المشرقية واخترت منها فقهاء العراق والمدرسة المغاربية واخترت فقهاء الأندلس، ومن خلال البحث وجدت أنالأندلسيين أكثر استدلالا بعمل أهل المدينة نظرا لعدم وجود فضاء للجدل والنقد، فقد كان مالكية الأندلس لا يتزاحمهم المذاهب الفقهية، بخلاف فقهاء العراق الذين دافعوا عن المذهب أمام فقهاء الحنفية والشافعية والحتابلة باعتبار بغداد والكوفة والبصرة حواضر لهذه المذاهب وختمت ببعض التطبيقات لكلتا المدرستين وأهم النتائج التي توصلت إليها. والله الموفق.
