الملخص
الملخص : قررت التشريعات الجزائية وضع حماية خاصة لفئة ذوي الإحتياجات الخاصة ، نظرا لما تتعرض له من تهميش بسبب ضعفها البدني أو العقلي على رد الإعتداء الذي قد تتعرض له ، و ذلك بتقرير عقوبات مشددة على الجرائم التي يكون محلها الشخص من ذوي الإحتياجات الخاصة ، و منها جريمتي الإتجار بالبشر و الإتجار بالأعضاء البشرية . فهذه الظواهر الإجرامية تستهدف سلامة الفرد المعاق الجسدية و تستغل ضعف هذه الفئة و عجزها ، لذا تعتبر صفة العجز و الإعاقة في الضحية هي ظرف مشدد على كل من يرتكب الجرائم ضد ذوي الإحتياجات الخاصة . و تهدف هذه الدراسة إلى التطرق لأحكام هذا النوع من الجرائم الماس بشخص هذه الفئة و مدى خطورتها ، و هذا ما سنوضحه من خلال هذه الورقة البحثية . الكلمات المفتاحية : ذوي الإحتياجات الخاصة ، نزع الأعضاء، جريمة الإتجار بالبشر ، جريمة الإتجار بالأعضاء البشرية ، الحماية الجنائية . Abstract: The penal legislation decided to put special protection for the category of people with special needs, in view of the marginalization that it suffers from, because of its physical or mental weakness, to return the assault, by deciding severe penalties for the crimes that the person has with special needs, Including the crimes of human trafficking and trafficking in human organs. These criminal phenomena target the physical integrity of the individual and take advantage of the weakness and disability of this group.so, the status of disability in the victim is considered an aggravating circumstance for the offenders against people with special needs.And this study aims to address the provisions of this type of diamond crime in the person of this category and its severity, This is what we will indicate through this research paper. key words : People with special needs, the removal of organs, crime of human trafficking , crime of trafficking in human organs, criminal protection.
