دور شرطة العمران في المحافظة على النظام العام الجمالي

الملخص
تتناول هذه الدراسة موضوع دور شرطة العمران في المحافظة على النظام العام الجمالي بالنظر إلى الإختلالات التي أصبحت تشوه المنظر العام للمدن الجزائرية، مما دفع المشرع إلى إدراج البعد الجمالي في العديد من النصوص القانونية والتنظيمية ذات الصلة بالنشاط، و يهدف الباحث من خلال هذه الدراسة الوقوف على طبيعة المهام التي يتمتع بها أعوان جهاز شرطة العمران في معاينة وتقصي انتهاكات الرونق الجمالي للمدينة والجزاءات المقررة لها. وفي الختام تم التوصل إلى عدة نتائج أهمها حجية المحاضر المحررة من طرف أعوان شرطة العمران كأداة لإثبات المخالفات التي تمس بالجوانب الجمالية للمدينة مع إختلاف طبيعة الجزاء التي توقعه السلطات الإدارية أو القضائية المختصة ضد كل من يخالف قواعد النظام العام الجمالي. This study deals with the role of the urban police in maintaining Aesthetic Public Order, with looking to imbalances that became distorting the general view of Algerian cities, which encouraged the legislator to include aesthetic dimension in many legal texts related to urban activity, The researcher aims through this study know the nature of the authorities enjoyed by the agents of the urban police in the inspection and investigation violations of the esthetic luster of the city and the sanctions provided for it. In conclusion, several conclusions were reached, the most important of which is the authoritative records written bay agents of the urban police as a tool to prove violations affecting aesthetic aspects of the city, with a difference in the nature of the penalty imposed by administrative or judicial authorities against anyone who violates rules of asthetic public order.
