أسباب عدم خضوع التنظيمات لرقابة المجلس الدستوري الجزائري The Reasons For Not Subjecting The Regulations To The Control Of The Algerian Constitutional Council

الملخص

يهدف هذا المقال إلى دراسة وحصر الأسباب التي حالت دون خضوع التنظيمات إلى رقابة المجلس الدستوري الجزائري. لقد تبين أنها ترجع إلى ثلاثة أسباب أساسية: يتمثل الأول في تقليد النموذج الفرنسي رغم خصوصيته في إنشاء مجلس دستوري لرقابة وضبط البرلمان دون الحكومة وتنظيماتها، وأسبقية إنشاء مجلس الدولة وتفضيله في رقابة التنظيمات، والثاني في تأثر الفقه الجزائري بنظيره الفرنسي في هذا الخصوص. ويرجع الثالث منها إلى الدور المحوري لرئيس الجمهورية في الدساتير الجزائرية واستئثاره بتعديل الدستور على نحو يضخم صلاحياته ولا يرتب أية رقابة عليه. This article aims to study the reasons that have prevented regulations from being subject to the control of the Algerian constitutional council. That it is due to three basic reasons: The first is to imitate the French model despite its specificity in establishing a constitutional council to control parliament, not the government and regulations. The second is that Algerian jurisprudence has been affected by its French counterpart. The third of them is the pivotal role of the President of the Republic in the Algerian constitutions and his exclusivity in amending the constitution in a way that inflates his powers and does not place any control over him.
