الملخص
ملخص حظيت الأملاك الوقفية بحماية جزائية بموجب قانون العقوبات وقانون الإجراءات الجزائية، وكذلك بموجب قانون الأوقاف رقم 91-10 المعدل والمتمم، وهذا بهدف ردع كل من تسوّل له نفسه المساس بهذه الأملاك الوقفية، غير أنه لتقرير الحماية الجزائية يجب توافر الأركان العامة للجريمة، والأركان الخاصة بجريمة التعدي على الملكية الوقفية بشكل خاص. والتي تتمثل في جرائم التزوير وجرائم استغلال ملك وقفي بطريقة متسترة أو تدليسية، وجرائم إخفاء عقود أو وثائق أو مستندات الوقف، وجرائم تدنيس المساجد ودور العبادة، وقد رصد المشرع الجنائي العقوبة المناسبة لكل جريمة. Abstract: Endowment properties enjoyed criminal protection under the penal code and the code of criminal procedure, as well as under the Endowment Law N°91-10 as amended and suopplemented, and with the aim of deterring everyone who sought to prejudice these endowment property, however, the Penal Protection Report must provide the crime and the elements of the crime of property infringement Especially endowment. Which include crimes of forgery and crimes of exploitation of a waqf property in a veiled or fraudulent manner, crimes of concealing contractes, documents or endowment documents, of mosques and places of worship ,and the criminal legislator, has monitored the appropriate punishment for each crime. Résumé: Les biens de dotation bénéficiaient d’une protection pénale en vertu du code pénal, et du code de procédure pénale, ainsi qu’en vertu de la loi de dotation n° 91-10 amendée et complétée, ce qui vise à dissuader tous ceux qui se demandent de porter atteinte à la propriété waqf en particulier. Qui incluent les crimes de contrefaçon, les crimes d’exploitation d’un bien waqf de manière voilée ou frauduleuse, les crimes de dissimulation de contrats, de documents de dotation et les crimes de profanation des mosquées en tant que culte de culte.
