الحقوق الاجتماعية للسجين من منظور فقهي Social Rights Of The Prisoner From A Doctrinal Perspective

الملخص
ملخص البحث الحمد لله ربِّ العالمين, والصلاة والسلام على أشرف المرسلين محمَّد -صلى الله عليه وسلم- وعلى آله وصحبه أجمعين. إن السجن في الإسلام شرع للزجر والتأديب والإصلاح , ولايعني ذلك تجريد السجين من حقوقه , بل حفظ له الإسلام هذه الحقوق ؛ لكونه حريص على تقوية العلاقات الاجتماعية بين أفراد المجتمع , فإذا تعرض المسلم للسجن هل تسقط حقوقه الاجتماعية ويكون فرداً منبوذاً من المجتمع ؟ أم أن الإسلام حفظ له حقوقه وهو في السجن وخارجه!!؟ تكمن مشكلة البحث في كيفية حفظ الإسلام لحقوق السجين خلال وجوده في السجن وبعد خروجه؛ حيث يوضح البحث آراء الفقهاء في الحقوق الاجتماعية للسجين ، وكيف تكون الرعاية له بعد انتهاء مدة سجنه ؟ ويهدف هذا البحث إلى بيان الأحكام الفقهية في حقوق السجين الاجتماعية ، وبيان الأدلَّة عليها وتوضيح كيفية الرعاية اللاحقة للسجين ، وقد اتَّبعتُ فيه المنهج الوصفي التحليلي، وهو أنسب المناهج لمثل هذا النوع من الدراسات، وكذلك المنهج المقارن في بيان آراء الفقهاء والمقارنة بينها ؛ مع بيان الأرجح منها بالأدلة من المصادر الشرعية، وتتمثل أهميَّة هذا البحث في الإجابة عن السؤال التالي: هل للسجين حقوق اجتماعية مع أسرته خلال سجنه؟ وهل يجب على الدولة رعايته اجتماعيًا بعد خروجه وقضاء مدة حكمه؟ . تتألَّفُ خطة البحث من مبحثين تحت العناوين التالية: المبحث الأول : حقوق العلاقات الاجتماعية ، ثم المبحث الثاني: حقوق الرعاية اللاحقة للسجين. وقد خَلُصَ البحث إلى عددٍ من النتائج، والتوصيات. Research Summary Praise be to Allah, Lord of the Worlds, and peace and blessings be upon the noble messengers of Muhammad - peace be upon him - and his family and companions. Prison in Islam is prescribed for restraint, discipline and reform, and this does not mean stripping the prisoner of his rights. Or that Islam has his rights while in prison and outside !!? The research problem lies in how Islam preserves the rights of the prisoner during his presence in prison and after his release. This research aims to explain the jurisprudence provisions in the social rights of the prisoner, and the evidence of it and to clarify how aftercare of the prisoner, and I followed the descriptive analytical approach, which is the most appropriate approach for such studies, as well as the comparative approach in the statement of opinions of scholars and compare them; The evidence from legitimate sources. The importance of this research is to answer the question: Does the prisoner have social rights with his family during his imprisonment? And should the state sponsor him socially after he leaves and spend his sentence? The research plan consists of two subjects under the following headings: The first topic: the rights of social relations, then the second topic: the rights of after-care of the prisoner, at the end of the research, the most important sources and references. Résumé de la recherché Louange à Allah, Seigneur des mondes, et que la paix et les bénédictions soient sur les nobles messagers de Mahomet - que la paix soit sur lui - et sur sa famille et ses compagnons. La prison en Islam est prescrite pour la retenue, la discipline et la réforme, et cela ne signifie pas priver le prisonnier de ses droits. Ou que l'islam a ses droits en prison et à l'extérieur !!? Le problème de la recherche réside dans la manière dont l'islam préserve les droits du détenu pendant sa présence en prison et après sa libération. Cette recherche vise à expliquer les dispositions de la jurisprudence sur les droits sociaux du détenu, et les preuves de celle-ci et à clarifier comment le suivi du détenu, et j'ai suivi l'approche analytique descriptive, qui est l'approche la plus appropriée pour de telles études, ainsi comme l'approche comparative dans la déclaration d'opinions des universitaires et de les comparer; Les preuves provenant de sources légitimes. L'importance de cette recherche est de répondre à la question: le détenu a-t-il des droits sociaux avec sa famille pendant son incarcération? Et l'État devrait-il le parrainer socialement après son départ et passer sa peine?. Le plan de recherche se compose de deux sujets sous les rubriques suivantes: Le premier sujet: les droits des relations sociales, puis le deuxième sujet: les droits de suivi du détenu, à la fin de la recherche, les sources et références les plus importantes .
