Algeria's Experience In Creating Independent Administrative Authorities تجربة الجزائر في استحداث السلطات الإدارية المستقلة

Abstract

In the framework of the reforms and modernization processes adopted by Algeria, many regulatory bodies have been created since 1990. By taking this legal form of Comparative law as a new way of governing, that fostering transparency, consultation and negotiation, as well as providing professionalism, effectiveness, and impartiality in resolution of problems and in interventions, under the "Regulatory State". This research comes in the context of identifying the concept of the term "Independent Administrative Authorities" (IAAs), and to find out the Algeria's experience in creating this category of regulatory structures in various fields, such as: media, protection of citizen's rights, economics, and finance. Through all the statutes relating to the creation, re-creation, suppression or replacement of such bodies in different areas. Further research is always needed in this area, which is constantly changing, in order to ensure that the legal institutional system remains consistent, stable and sustainable. في إطار الإصلاحات وعمليات التحديث التي تبنتها الجزائر، بدأت منذ عام 1990 في إنشاء العديد من سلطات الضبط، باقتباس هذا الشكل القانوني عن القانون المقارن كطريقة جديدة للحكم، تعزز الشفافية، التشاور والتفاوض، وتتيح التدخل وحل المشاكل بقدر من المهنية والكفاءة، مع ضمانها للحياد، في ظل "الدولة الضابطة". هذا البحث يأتي في سياق تحديد مفهوم "السلطات الإدارية المستقلة" وتشخيص تجربة الجزائر في استحداث هذه الفئة من الهيئات الضابطة في مختلف المجالات: مثل الإعلام، حماية حقوق المواطنين، الاقتصاد، والمالية. مع حصر جميع النصوص القانونية المتعلقة بإنشاء هذه الهيئات، الغائها، إعادة إنشائها أو استبدالها في جميع الميادين. حيث تبقى هناك حاجة دائمة إلى المزيد من البحوث في هذا المجال، الذي يتغير باستمرار، بغرض ضمان استقرار النظام القانوني والمؤسساتي وبقائه متسقا ومستداما.
