الانتخابات وشرعية المؤسسات مع الاشارة لحالة الجزائر

الملخص
الملخص تلعب الانتخابات الحرة والنزيهة دورا هاما في اضافة الشرعية على النظام القائم، فاذا كان الدستور يقر بأم الشعب هو مصدر كل سلطة وان الشعب يختار لنفسه مؤسسات غايتها المحافظة على الاستقلال الوطني ودعمه، وبان الشعب حر في اختيار ممثليه وله الحق في ممارسة سيادته عن طريق الاستفتاء وبواسطة المؤسسات الدستورية والمنتخبين الذين يختارهم فانه من الواضح ان شرعية هذه المؤسسات من عدمها تكمن اساسا في العلاقة التي تربط الحاكم بالمحكوم، وينشأ من هذا التحديد أن الشرعية تساهم في استقرار الحالة بين الحاكم والمحكومين وتقود الى استقرار المجتمع بالكامل ما دام مفهوم الشرعية كما اشاعه مبدعه "ماكس فيبر" يرجع في اخر التحليل إلى واقع الرضا الفعلي وليس الى الاكراه. فالانتخابات هي حلقة الوصل والجوهر في هده العلاقة. Summary : Free and elections play an important role in legitimizing the established regime. While the constitution states that the people is the source of all authorities, the people elects to establish institutions that maintains and supports national independence, the people chooses freely their representatives and the right to exercise its own sovereignty through referendums and elections and constitutional institutions ; it is clear that the (il)legitimacy of these institutions depends on the relationship between who rules and who is being ruled. As a result, legitimacy, in this meaning, contribute to the stability of the entire society as long as the concept of legitimacy, as inspired by Max Weber, reflects the public consent/satisfaction, not coercion. In this context, elections are the essentially indispensable link in such a relationship
