حقوق الطفل وتطورها في ضوء مبادئ الشريعة الاسلامية والمواثيق الدولية -مقاربة تأصيلية مفاهيمية-

الملخص
هدفت الدراسة الى معرفة التطورات التي عرفتها المنظومة القانونية والترسانة المعدة لحماية الأطفال من كافة الانتهاكات التي قد تطال أوتعتدي على الطفل باعتباره قاصرا وغير مدركا ويحتاج الى الرعاية عبر الولي أو الأولياء أو الحاضنة الأسرية ،وتطرقنا في ذلك الي التأصيل المفاهيمي للطفل والأسرة معا اضافة الى استعراضنا أهم التطورات التاريخية التي اندرجت واكتسبت وتعززت بفضلها الترسانة القانونية الكفيلة بحماية حقوق الطفل بدءا من مبادئ الشريعة الاسلامية السمحاء مرورا بأغلب المواثيق والاتفاقيات الدولية ،وتم ذلك عبر ثلاث محاور أساسية أولها التأصيل المفاهيمي والنظري لمفهومي الطفل والأسرة ،وثانيها دور الأسرة كلبنة أساسية راعية لحقوق الطفل وفق المعاهدات والمواثيق الدولية أما المحور الأخير فاستعرضنا فيه مفهوم حقوق الطفل في ضوء مبادئ الشريعة الاسلامية. : The study aimed to find out the developments in the legal system and the arsenal designed to protect children from all violations that may affect or attack the child as he is a minor and unaware and needs care through the guardian, guardians or family foster ،In this, we dealt with the conceptual rooting of the child and the family together, in addition to our review of the most important historical developments that have been incorporated, acquired and strengthened thanks to them the legal arsenal ensuring the protection of child rights, starting from the principles of the tolerant Islamic Sharia through most international charters and agreements, and this was done through three main axes, the first of which is the conceptual and theoretical rooting of the concepts of the child The family, and the second is the role of the family as a basic child that cares for the rights of the child according to international treaties and covenants. As for the last axis, we reviewed the concept of child rights in light of the principles of Islamic law.
