مسؤولية أعضاء مجلس الدولة

الملخص
ملخص: أنّ مجلس الدولة ليس بالمؤسسة الاعتيادية التي تعتمد في أداء وظيفتها على الروتين المعتمد في المؤسسات الإدارية، وإنما يقوم بأداء مهمة تتميز بالطابع الفني، وتعتمد على استقلال وحياد وبراعة أعضائه، فالمجلس يقوم بمهمة إعداد وصياغة مشروعات القوانين وتفسيرها، ويقوم بمهمة إبداء الرأي وتقديم المشورة للجهات العليا في الدولة، فضلاً عن دور المجلس في مجال القضاء الإداري، ولما كان عضو مجلس الدولة إنسان قد يُخطئ وقد يُصيب، ولما كانت أعماله على درجة كبيرة من الأهمية، فأنّ لممارسة العضو هكذا أعمال لابد وأنّ تضعه في نطاق المساءلة، سواء أكانت جنائية أم تأديبية. وقد اختلفت التشريعات المتعلقة بتنظيم مجالس الدولة في شأن القواعد الخاصة بمساءلة أعضائها، وهي قواعد تختلف بطبيعتها عن قواعد المساءلة الخاصة بالأفراد أو الموظفين العاديين، إذ يتمتع أعضاء المجلس بضمانات مهمة لحمايتهم من الاعتداء عليهم وحفاظاً على استقلاليتهم وحيادهم أثناء ممارستهم لأعمالهم وربما قيام أي من المسؤوليتين، وهما الحصانة الإجرائية والحصانة التأديبية، مع التأكيد على أنّ هذه الضمانات لا تحول من دون مسائلتهم عما يقع منهم من أخطاء أو انحرافات أثناء أداء واجبهم. Abstract The State Council is not a regular institution that depends on the performance of its functions on the routine adopted in the administrative institutions, because the council performs a task characterized by a technical nature, and depends on the independence, impartiality and ingenuity of its members. The Council is responsible for the preparation, drafting and interpretation of draft laws, and is responsible for consulting supreme authorities in the State, as well as its role in the field of administrative justice. Accordingly, the member of the Council of State, as a human who may be mistaken and may be right, must be placed within the scope of accountability, whether criminal or disciplinary. Legislation concerning the organization of State Councils differs about the rules concerning the accountability of their members, so, they differ - in nature - from the rules of accountability of ordinary individuals or officials. Members of the Council have important safeguards to protect them from abuse and to maintain their independence and impartiality during their work. Which are the procedural and disciplinary immunity, with the assurance that such guarantees do not preclude their liability for errors or omissions in the performance of their duties
