الأرشيف القضائي في الجزائر: بين الواقع والأفاق

الملخص
يعتبر الأرشيف القضائي من أهم أنواع الأرشيف، لما تتميز به وثائقه من أهمية وسرية بالنسبة للدولة والأفراد، مما يستلزم ضرورة الاهتمام به ووضع استراتيجيات وآليات خاصة لحمايته والحفاظ عليه، وهذا ما يجعل وزارة العدل الجزائرية تسعى إلى إيجاد حلول علمية لحفظه والمحافظة عليه، خاصة بعد الحالة المزرية التي هو عليها في معظم الجهات القضائية عبر التراب الوطني جراء تراكم الأرصدة وتزايد أعدادها بصورة هائلة. وهذا ما يدفع وزارة العدل إلى إعادة النظر في طريقة تسيير وتنظيم الأرشيف القضائي وفقا لتشريعات تنظيمية جديدة تتماشى والوضع الجديد الذي يعيشه العالم من تطور تكنولوجي وتقني في كل المجالات، خاصة وان وزارة العدل الجزائرية قد انتهجت نهج عصرنة القطاع، وتبنيها لنظام آلي جديد للتسيير الالكتروني للعمل القضائي والإداري "SGDJ " بكل المحاكم والمجالس القضائية، هذا الأخير الذي اثبت نجاعته في تسهيل وتطوير العمل القضائي، إلا أن الأرشيف القضائي بقي مهمشا في ظل هذا النظام التكنولوجي الجديد. من هنا جاءت هذه الدراسة لتنقل واقع الأرشيف القضائي ببعض المحاكم الجزائرية، وإجراءات وتدابير وزارة العدل لتسييره وتنظيمه، إضافة إلى معرفة النصوص القانونية المعتمدة في تسييره إلى حد الآن، إلى جانب التطرق إلى آفاق وزارة العدل الجزائرية في مجال حفظ ومعالجة الأرشيف القضائي وتحسين وضعيته والمحافظة عليه The judicial archive is one of the most important types of archive, because its documents are important and confidential for the State and individuals, which necessitates the need to pay attention to it and develop special strategies and mechanisms to protect and preserve it, which is why the Algerian Ministry of Justice is seeking to find scientific solutions to preserve and preserve it, especially after the deplorable situation that is in most jurisdictions across the national territory due to the accumulation of assets and the huge numbers. This is why the Ministry of Justice is reconsidering the way in which the judicial archive is administered and regulated in accordance with new regulatory legislation in line with the new situation in which the world is experiencing technological and technical development in all areas, especially since the Algerian Ministry of Justice has adopted a modernisation approach to the sector and adopted a new automated system for the electronic management of judicial and administrative work (SGDJ) in all courts and judicial councils, the latter of which has proved to facilitate and develop judicial work, but the judicial archive has remained marginalized under this new technological system. This study, in addition to the knowledge of the legal texts adopted in its administration so far, in addition to addressing the prospects of the Algerian Ministry of Justice in the field of preserving and processing the judicial archive, improving its status and maintaining it, has been studied.
