الملخص
وتهدف هذه الدراسة إلى تناول جريمة الاختلاس في القطاع الخاص في التشريع الجزائري وفقا للقانون 06/01 المتعلق بالوقاية من الفساد ومكافحته، وذلك بالتطرق إلى مختلف عناصر هذه الجريمة ومقارنة تجريمها باتفاقية الأمم المتحدة لمكافحة الفساد، وفي بعض التشريعات المقارنة من أجل الوقوف على مدى نجاعة السياسة العقابية التي أقرها المشرع الجزائري لمكافحة هذه الجريمة وقمعها مقارنة بغيره من التشريعات. وذلك من أجل معرفة مدى مسايرة المشرع الجزائري والتشريعات المقارنة لاتفاقية الأمم المتحدة لمكافحة الفساد. Abstract: This study aims to address the crime of embezzlement in the private sector in Algerian legislation in accordance with Law 06/01 related to the prevention and control of corruption, by examining the various elements of this crime and comparing criminalization in the United Nations Convention against Corruption, and in some comparative legislation in order to determine the extent of efficacy The punitive policy approved by the Algerian legislature to combat and suppress this crime compared to other legislation. This is in order to know the extent of keeping pace with the Algerian legislature and the comparative legislation of the United Nations Convention against Corruption.
