جرائم التعدي على التراث الثقافي المنقول في التشريع الجزائري Offences Against Movable Cultural Heritage In The Algerian Legislation

الملخص
يعد التراث الثقافي أحد الأبعاد الرئيسية المؤسسة للهوية الثقافية ، فهو يمثل شكلا من أشكال التعبير الثقافي المرتبط بماضي الشعوب ، كما يعتبر كذلك أحد ركائز التنمية المستدامة في كل جوانبها الاقتصادية و الاجتماعية و الثقافية و حتى البيئية وعليه فإن انتشار جرائم الاعتداء على ذلك التراث في جميع أنحاء العالم بصفة عامة و الجزائر بصفة خاصة بات يشكل خطرا على الصعيدين معا . وتبعا لذلك أصبح من الضروري تقرير حماية قانونية عن طريق وسائل و إجراءات مخولة للدولة من أجل تحقيق عدم الاعتداء ، و ذلك بتخصيص جملة من العقوبات تفرضها الهيئات المخولة لذلك على الأطراف المخالفة لقواعد التشريع الخاصة بحماية التراث الثقافي. اعتمادا على ما سبق جاء موضوع الدراسة المقترح لتوضيح جرائم التعدي التي نص عليها كل من قانون حماية التراث الثقافي و قانون العقوبات على الممتلكات المنقولة ، و ذلك قصد حصر هذه الجرائم و بيان الجزاءات المقررة لها بموجب تلك النصوص سعيا منا لتقديم ما يلاءم من توصيات تبين تلك الثغرات التي وقع بها المشرع في مجال حماية تراثنا الثقافي . Abstract: The cultural heritage is a cornerstone of the cultural identity as it is considered one of the forms of cultural expression pertaining to the past of the nations. Moreover, the cultural heritage is one of the main foundations of sustainable development on economic, social, cultural and environmental aspects. Subsequently, the spread of offences against the cultural heritage throughout the world in general and in Algeria in particular, endangers both sides. Therefore, it is necessary to ensure judicial protection through ways and means allowing the State to fight against offence as the statutory authorities shall impose penalties to those who infringe the rules of preserving cultural heritage. In the light of the foregoing, we have proposed the research topic in order to highlight the offences provided for in the Law on preserving the cultural heritage and the Penal Code against the movable property to identify those offences and fix the corresponding penalties under the above-mentioned laws in our concern to propose the appropriate recommendations likely to emphasize the vulnerabilities faced by the legislator in terms of preserving our cultural heritage.
