قَاعِدَةُ الْيَسِيرِ الْمَعْفُوِّ عَنْهُ وَأَثَرُهَا فِي الْمُفَطِّرَاتِ الطِّبِّيَّةِ

الملخص
يتناول البحث موضوعًا مهمًّا تمسّ الحاجة إلى معرفته في زماننا ألا وهو أحكام بعض المفطِّرات الطبية من زاوية إعمال القواعد الفقهية في إبراز الأحكام الشرعية لها؛ فجاء موسومًا بما يأتي: "قاعدة اليسير المعفوّ عنه وأثرها في المفطِّرات الطبية"، وقد أجاب عن إشكال رئيس هو: "ما مدى تأثير قاعدة اليسير المعفو عنه في المفطِّرات الطبية؟". وبعد التعريف بالقاعدة محلّ الدراسة، تطرّق البحث إلى عدد من القضايا هي: بخاخ الربو، وغاز الأكسوجين، وقطرة الأذن، وقطرة العيْن، وقطرة الأنف. ومما توصّل إليه البحث أنه إذا اتّحدت القواعد والأصول قلّ الخلاف كثيرًا، وانحصر في تحقيق المناط، ولذلك كانت المسائل المتناولة في البحث محلّ إجماع أو اتّفاق معظم الفقهاء المعاصرين على الرغم من اختلاف مذاهبهم ومدارسهم الفقهية. The research deals with an important subject that needs to be known in our time; It is the provisions of some medical fasting nullifiers from the standpoint of the implementation of the jurisprudence rules in order to highlight their legal Islamic. It is entitled “The Rule of the Little Forgiving (Yassir) and its Effect on Medical Fasting Nullifiers”. It answered the following main problematic: "To what extent does the Rule of the little forgiving affect medical fasting nullifiers?” After the definition of the rule in question, the research dealt with a number of issues: Asthma sprays, oxygen gas, ear drops, eye drops, and nose drops. The research concluded that when rules and fundamentals get more common points there will be lesser disagreement and might be confined just to achieving the assigned questions. This explains why were jurisprudential questions in this research consensual by contemporary jurists despite these latter’s different jurisprudence schools.
