الملخص

في ظل تنامي استخدام التقنية المعلوماتية أضحى الأمن المعلوماتي من أبرز العناصر اللازمة لتوفير بيئة مناسبة لبناء مجتمع معلوماتي، وأصبحت الميزة التنافسية بين مختلف المؤسسات بل وحتى المجتمعات؛ هي مدى نجاحها في حماية أنظمتها المعلوماتية، الأمر الذي دفعها لتقرير نظام التصديق الإلكتروني. ولأن الاهتمام بالتوثيق الإلكتروني يفرض نفسه في مجال المعاملات الإلكترونية، فإن موضوعه يثير العديد من الأسئلة من قبل الباحثين في هذا المجال خصوصا مسألة الربط بين النظام القانوني لشهادة التصديق الإلكتروني والقيمة القانونية لها، وهو ما سنحاول معالجته في هذه الدراسة. Abstract : In light of the growing use of information technology, information security has become one of the most important elements necessary to provide an appropriate environment for building an information society, and the competitive advantage has become among various institutions and even societies. Is the extent of its success in protecting its information systems, which prompted it to decide the electronic certification system. And because the interest in electronic authentication imposes itself in the field of electronic transactions, its topic raises many questions from researchers in this field, especially the issue of linking the legal system of the electronic certification certificate and its legal value, which we will try to address in this study.
