الملخص
تعتبر جريمة الرشوة في مجال الصفقات العمومية، من أكثر جرائم الفساد تفشيا في الوسط الإداري، والتي أصبحت تهدّد الإقتصاد الوطني. باِعتبار أنّها تمس المبادئ العامة لابرام الصفقة وتنفيذها، خاصة في ظل غياب الرقابة، ممّا أدى إلى حتمية الإنتقال والتحول من الإدارة التقليدية إلى الإدارية الإلكترونية، وما تحمله هذه الأخيرة من آثار إيجابية في القضاء على الفساد الإداري، نظرا لغياب الأطر الزمكانية في التعامل الإداري من خلال التعاقد عن بعد، ومن ثم ضمان شفافية الإجراءات وتبسيطها بداية من النشر الإلكتروني إلى غاية تنفيذ الصفقة، خاصة أنّ التعاقد مابين الإدارة والمتعامل المتعاقد يتم عن طريق وسيط إلكتروني، بعيدا عن الموظف العام ممّا يقلل ويقضي على جريمة الرشوة على طغت في التعاقد التقليدي. Abstract The crime of bribery in public procurement is considered one of the most pervasive corruption crimes in the adminstrative sector, which have become a threat to the national economy as it touches on the general principal of concluding and excuting the deal, especially in the absence of oversight, which has led to the imperative of transition and transformation from traditional administration to electronic administration, and what it carries the lettre has positive effects in eliminating administrative corruption and given the absence of time and space frameworks into administrative dealing through remote contracting, and them ensuring the transparensy of the deal especially since of the contract between the administration and the contacting custumer is done through an electronic broker away from the public employee, which reduces and eliminates the crimes of bribery that overshadowed the traditional contract
