الإشكالات التي يثيرها العقار الصناعي كمحل للنشاط الإستثماري في الجزائر

الملخص
مـلخـص: حضت المسائل الصناعية في الجزائر بالعديد من البحوث العلمية في الشأن القانوني، مع الأخذ بعين الاعتبار أن العامل الأساسي لنجاح الصناعة أو إخفاقها هو العقار،الذي لم يحض بالعناية والاهتمام الكافي إلا مؤخرا، سواء من طرف السلطات العمومية أو الباحثين. والعقار الصناعي هو مصطلح يعبر عن استخداماتالأرض، وهو متميز بخصائصمنفردة تميزه عن أنظمة عقارية أخرى لا تقل أهمية،فحسن استغلاله وتسييره تحفز الاستثمارات المحلية، وتجذب الاستثمارات الأجنبية، بما يعود بالفائدة على تلك الدولة من مناح عدة، مساهما بذلك في المزيد من النمو الاقتصادي، ووعيا بهذا الرهان، تبنت الدولةنظم متنوعة لحافظة العقار الصناعي،متباينة في خصوصيتها وإجراءاتها،وطبيعتها القانونية، وطرق تسييرها وآليات حمايتها، والاشكالات الناتجة عن استغلالها، والمنازعات الناجمة عن مسألة الاختصاص القضائي التي أثارت العديد من الاشكالات والملابسات. إن واقع العقار في الجزائر حقيقة مايزال يشكو فعلا من جملة معيقات تسمم بيئة الأعمال أخرجته من مقام الدور المنوط به في مجال التنمية وتشجيع الاستثمار، ولعل هذا ما لفت اتنباه القانونيين بصفة خاصة، حيث أصبح موضوع إهتمام ومحل مناقشة جادة،وذلك من خلال عقد العديد من الندوات الوطنية، وإدراج مختلف الملتقيات الوطنية والدولية ، والمواطن بصفة عامة باعتباره يحتك أو يكاد يصطدم بهذا الشأن المتعلق بالعقار الصناعي في مسألة أو أخرى، مما يستدعي ضرورة إيجاد حلول مناسبة وعاجلة. Abstract: The industrial issues in Algeria have undergone many scientific researches in the legal field, bearing in mind that the main factor for the success or failureof the industry is the drug, which has not received adequate care and attention until recently, whether by public authorities or researchers. The industrial property is a term that expresses the uses of the land, and it is distinguished by individual characteristics that distinguish it from other real estate systems that are no less important. Good exploitation and management stimulates local investments, and attracts foreign investments, in a way that benefits the country from several grants, thus contributing to more economic growth, Conscious of this bet, the state adopted various systems for the portfolio of industrial real estate, varying in its privacy and procedures,and legal nature,and methods of management, and protection mechanisms, and problems resulting from its exploitation and disputes arising from the issue of judicial jurisdiction that raised many proplems and confusion. The reality of real estate in algeria is reqlly still complaining about a number of barriers poisoning the business environment, it brought him out of the role assigned tohim in the field of development and investment promotion, perhaps this is what attracted the attention of the legal in particular jurists, as its became a topic of interest serious discussion and that is throught holding many national seminars and the insertion of various national and international meetings, and the citizen in general as friction or almost collid in this regard to industrial property in one matter or another which calls for the need to find appropriate and urgent solutions.
