الملخص
تعد مرحلة الطفولة مرحلة حساسة في حياة الفرد يمكن أن يقوم الصغير بأفعال مخالفة للقانون تكيف ضمن نطاق الجنوح، ولكي يتم التعامل مع تلك الظاهرة ومواجهتها قام المشرع الجزائري بإقرار ضمانات قانونية لسيما أثناء حبس الطفل الجانح مؤقتا. إذ أن الحبس المؤقت إجراء من إجراءات التحقيق، يهدف الي تحقيق التوازن بين مصلحة المجتمع من جهة وبين مصلحة الفرد من جهة أخرى، إلا أنه في ذات الوقت يشكل إعتداء صارخا على قرينة البراءة والحرية الفردية. Abstract Chilhood is regarded as a sentive period in the life of the individual wherein he or she may commit acts against the law. To deal with this phenomenon the Algerian legislation has adopted several legal gurantees particularly during the temporary detention of a juvenile delinquent. Pre-trial detention is measure of investigation aimed at balancing the interest of society on the one hand and the interest of the individual on the other, At the same time, however, it constitutes a flagrant assault onconstitutes a flagrant assault on and individual liberty..
