الملخص
شكلت مؤسسة الجماعة عنصر استمرار للتلاحم الذي تقوم عليه القبيلة، بحيث ظلت تعمل منذ ظهورها على ترسيخ الديمقراطية داخل القبائل الأمازيغية، ويتجلى ذلك في توزيع الاختصاص بين مؤسسة الجماعة كسلطة تشريعية قائمة الذات، والسلطة القضائية بيد المحاكم العرفية، لتبقى السلطة التنفيذية من اختصاص أمغار، وقد تتوقف سلطته حيث تبدأ السلطتين التشريعية والقضائية طبقا لمبدأ فصل السلطات. وبناء على هذا الوضع فإننا نستنتج أن الجماعة تشرف على سير الحياة بداخل القبيلة، وفق أعراف تضبط علاقتها بالقبائل المجاورة، حيث كان العرف المرجع الوحيد في النظام القضائي بزيان. غير أن التدخل الاستعماري الفرنسي خلخل هذه المؤسسة، بخلق جهاز إداري مهيمن على اختصاصات الجماعة، بل أدمج هذه المؤسسة في شبكة المراقبة التابعة للسلطة، وأصبح اختيار أعضاء الجماعة خاضعا لتعليمات السلطة الاستعمارية في تجاوز صريح لمبدأ الديمقراطية. Thedjamaa(commune) has always been an important establishment that contributes to the cohesion of the tribe, since its main purpose has always aimed to consolidate democracy within the Amazigh tribes , this can be illustrated in the distribution of the specialty between the Commune as a self-governing legislature and the judiciary governed by the common-law courts , As for the executive power, it is under the Amghar’s jurisdiction, and his authority may cease as the legislative and judicial powers begin in accordance with the principle of separation of powers, so Based on this situation, we conclude that this establishment supervises the life process within the tribe, According to the common-laws that control their relationship with neighboring tribes, where customs were the only reference in the judicial system in Zayane, but the French colonial intervention didn’t only dislocate the ordinary process of this djamaa(commune) by creating an administrative system that dominates all the spetialties of this institution, but also ,it incorporated this institution into the Authority's monitoring network. Therefore, the selection of the members of thedjamaa(commune) was subject to the instructions of the colonial authority in a clear violation of the principle of democracy.
