الأحكام المتعلقة بالتشوف الشرعي

الملخص
إن الحمد لله نحمده ونستعينه ونستغفره، ونعوذ بالله من شرور أنفسنا، ومن سيئات أعمالنا، من يهده الله فلا مضل له، ومن يضلل فلا هادي له، وأشهد أن لا إله إلا الله وحده لا شريك له، وأشهد أن محمدًا عبده ورسوله. أما بعد.. فقد صار التشوف من المصطلحات المشهورة عند الفقهاء، فإنهم يذكرونه في أبواب العتق والنكاح والنسب وغيرها، والأحكام الفقهية قد تختلف حسب الأحوال والأشخاص والزمان والمكان، ومن المؤثر في هذه الأحكام الفقهية: التشوف الشرعي، لاسيما عند وجود مظنة التعارض بين أمور مختلفة والتشوف في أحدها؛ فإننا نقدم ما فيه التشوف ترجيحاً لموافقة الشارع فيما يتشوف له. وكتبت في ذلك من خلال مقدمة وتمهيد وثلاثة فصول وخاتمة ـ المقدمة: وفيها بيان أسباب اختيار الموضوع وأهميته، وخطة البحث. ـ تمهيد: في التعريفات ـ الفصل الأول: التشوف في أبواب الحدود والقصاص ـ الفصل الثاني: التشوف في أبواب النكاح ـ الفصل الثالث: التشوف في بعض المعاملات ـ الخاتمة: وفيها أهم نتائج البحث، ومن أبرزها: -. التشوف لغة وكذا اصطلاحاً يدور حول الظهور والبُروز والرغبة الشديدة في الشيء. -. وأكد البحث على أن الستر على المسلم مأمور به شرعاً؛ وقد تشوفت الشريعة للستر، وعرفنا ذلك من كثرة النصوص الواردة في ذلك، وترتيب حد من الحدود على القذف، ودرء الحدود بالشبهات. -. وحين يتعارض التشوف للستر مع النهي عن المنكر، ينظر للستر، مع وجوب النصح. -. كذا تتشوف الشريعة لحفظ الأعراض، وفي إسقاط القصاص في النفس. فالعفو أفضل. -. والشريعة تتشوف إلى الاحتياط في الأبضاع، وإلى ثبوت الأنساب مهما أمكن. -. ويحل تشوف الرجعية لزوجها ليراجعها؛ كما يجوز تشوف المرأة للخطاب، وهو التجمل. -. وتبين أن تشوف الشريعة للعتق لا يقارن بغيره وينبني على هذا التشوف أننا في حال التردد في مسألة فإننا نرجح العتق وكذا أبان البحث أن الوقف من المعاملات التي ظهر فيها تشوف الشارع له جداً. ومن توصيات البحث ومقترحاته: النظر في أمثلة للتشوف معاصرة، وتطبيق كيفية التعرف على التشوف الشرعي، والتفريع عليها، والله أعلم. ملخص البحث باللغة الإنجليزية Praise be to God, we praise, seek help, and seek forgiveness, and seek refuge in God from the evils of yourself, and from the bad deeds of our actions, whoever God guides, does not mislead him, and whoever presses, then there is no guide to him, and I testify that there is no god but God alone who has no partner, and I testify that Muhammad is His servant and Messenger.
