التعدي على حق الملكية العقارية الفلاحية الخاصة في ظل قانون الثورة الزراعية واشكالية اثبات ملكيتها

الملخص
لقد أفرز تطبيق الأمر 71/73 المؤرخ في 08/11/1971 المتضمن الثورة الزراعية إيجابيات وسلبيات متعددة، اذ وعلى الرغم مما يحسب لهذا الأمر كونه سمح بمباشرة عملية مسح ريفي جزئي وتحقيق عقاري في ملكيات الخواص انتهت بتسليم شهادات ملكية لهم رغم انعدام السند أصلا، وذلك بعد مباشرة إجراءات تحقيق ميدانية كلفت بالقيام بها لجان مختصة، الا أنه ومع ذلك فقد حمل عدة قيود في مجال التصرف في العقار الفلاحي، كما شكل تطبيقه تعدي واسع على حق الملكية العقارية الفلاحية الخاصة، ما يعكس الدور الكبير الذي لعبه الأمر المذكور وما تلاه من أوامر ومراسيم صدرت خلال تلك الفترة في مجال تقييد حق الملكية الخاصة للأراضي الفلاحية، وذلك عن طريق اللجوء الى تأميم أراضي الخواص الفلاحية ضمن الصندوق الوطني للثورة الزراعية والحاقها بأملاك الدولة، مع ما طرحه هذا الاجراء من جدل يتعلق بمدى مشروعيته في ظل غياب دستور يسمح بذلك.
