قراءة مقارنة لبعض القوانين الصادرة لهيكلة الصكوك الإسلامية Reading And Comparing Some Of The Issued Laws Structuring Islamic Sukuk

الملخص
يتضمن المقال قراءة لأهم القوانين التي صدرت لهيكلة الصكوك الإسلامية في الدول العربية وهي القانونين الأردنيين، والقانون المصري والتونسي ومعيار سوق دبي، إلى جانب المقارنة بينهم وإبراز أهم النقاط الواجب التطرق إليها في إصدار القوانين. ومن النتائج المتوصل إليها أن أفضل قانون أُصدر هو القانون المصري لتطرقه إلى نقاط لم تتطرق إليه القوانين الأخرى، إلا أنه لم يكتب له التطبيق على أرض الواقع لأسباب سياسية بحتة. وإذا ما تم استثناؤه فإن القانون الأردني هو أفضل القوانين الخمسة وهذا ما يفسر حصوله على جائزة الإصدار الأول لسنة 2017؛ The article includes a reading of the most important laws issued to structure Islamic Sukuk in Arab countries, namely Jordanian laws, Egyptian and Tunisian law moreover the Dubai market standard, as well as comparing them and highlighting the most important points that must be addressed in issuing laws. One of the most important results reached that the best law issued is the Egyptian law, because the Latter one touches some points that are not touched by other laws, however, this law did not have the opportunity to be applied on the ground for purely political reasons. And if it is excluded, the Jordanian law is the best of the five laws, and this also explains why he received the First Issue Award for the year 2017;
