إثبات الوصية بالوسائل الحديثة رؤية تحليلية

ملخص 1. يتضمن البحث دراسة فقهية مقارنة لمسألة إثبات الوصية بالوسائل الحديثة، كالتسجيل الصوتي، والتسجيل بالصوت والصورة، ونحو ذلك، هل تثبت بها الوصية أم لا؟ وقد قام الباحث ببيان حكم الوصية، واختلاف الفقهاء في وسائل إثباتها، ورجّح الباحث أن القرينة تعد وسيلة من وسائل الإثبات إذا تحققت شروطها، وخلص إلى جملة من النتائج المهمة، منها: أن التسجيل الصوتي للوصية ليس وسيلة إثبات أو نفي، وإنما هو قرينة يستأنس بها، وأما التصوير المتحرك التلفزيوني فهو قرينة ضعيفة الدلالة في مجال الإثبات بشكل عام، ويهدف هذا البحث إلى بيان أحكام الوصية، وطرق إثباتها الحديثة، وتوضيح التأصيل الشرعي لهذا الموضوع. Abstract The research includes a comparative juristic study of the issue of proving the will by modern means, such as phonograms, etc, whether or not the will is proven? The researcher explained the ruling of the will, and the difference of jurists in the means of proving it, and the researcher suggested that the context is a means of proof if its conditions are met, and he concluded a set of important results, including: that the audio recording of the commandment is not a means of proof or negation, but rather a context that is based on it. As for mobile television photography, it is a weak indication in the field of evidence in general. This research aims to explain the provisions of the will, and modern methods of proof, and clarify the legal basis for this topic.
