Un Droit Pénal " Ordinaire" Pour Faire Face Au Covid-19

Résumé: Pour faire face à la crise sanitaire du covid-19 , l’Algérie a choisi d’une part de ne pas décréter officiellement un état d’urgence et de limiter ,d’autre part, l’instrument juridique de gestion de cette crise au décret exécutif sans avoir recours à la promulgation d’un texte à valeur législatif spécialement destiné à la prise en charge de toutes les questions qu’elle engendreraient. Le droit pénal étant toujours en première ligne en période de crise du fait que la justice pénal est un service public dont la continuité doit être assurée en toutes circonstances mais aussi parce que l’outil répressif sert à faire respecter les mesures de circonstance n’a pas été adapté aux circonstances. L’Algérie a donc choisi de faire face à la crise avec son droit pénal ordinaire. Cette article se propose d’étudier la pertinence de ce choix au regard des solutions apportées aux problèmes de droit pénal inhérents à la crise. Abstract: To cope with the covid-19 health crisis, Algeria has chosen, on the one hand, not to officially declare a state of emergency and, on the other hand, to limit the legal instrument for managing this crisis to executive decree without having recourse to the promulgation of a text with legislative value specially intended to take charge of all the questions which it would generate. Criminal law is always at the forefront in times of crisis because criminal justice is a public service, the continuity of which must be ensured in all circumstances, but also because the law enforcement tool is used to enforce the measures of circumstance. not been adapted to the circumstances. Algeria has therefore chosen to face the crisis with its ordinary criminal law. This article aims to study the relevance of this choice with regard to the solutions to the criminal law problems inherent in the crisis.
