الملخص
تسهر الدولة دائما على استمرار توفير حاجاتها ممثلة في عقود الصفقات من اشغال ولوازم و خدمات ودراسات والتي تعتبر ضرورة ملحة لتوفير حاجات السكان هذه العقود التي تكلف الدولة اعتمادات مالية ضخمة كان لزوما على الدولة إن تنظمها بموجب نصوص يتعين على كل مصلحة متعاقدة احترمها ضمن اطر قانونية تحمي المتعاقدين معا حيث تأثرت العقود الادارية ممثله في الصفقات العمومية على غرار جميع العقود بجائحة كوفيد 19 وكان لها النصيب الاكبر في اختلال التوازن العقدي بين الطرفين فمابين واجب تلبية حاجات المجتمع وضرورة توفير الخدمات وبين حتمية التوقف عن انجاز المشاريع كانت الادارة في مواجهة مجموعة من الاشكالات فهناك صفقات تم ابرامها قبل تفشي الوباء وهي الان في طور الانجاز ولم يستطع المتعاقدين من انهائها وأخرى تعتزم مختلف المصالح المتعاقدة ابرامها لسد الحاجيات الانية والملحة والتي في مجملها تكتسي طابعا استعجاليا يتوجب الاسراع في تنفيذها على غير المعمول به في الظروف العادية . The state always ensures continuous provision of its needs represented in the purchase contracts of works, supplies, services and studies, which are an urgent necessity to provide for the needs of the population. These contracts cost the state huge financial credits that the state had to organize according to provisions that each contracting interest must respect within legal frameworks that protect The contractors together . Where the administrative contracts, represented in the purchase contracts, were affected, as all contracts were affected by the pandemic of Covid 19, and they had the largest share in the imbalance of the contractual balance between the two parties. Concluding it before the outbreak of the epidemic, and it is now in the process of completion, and the contractors have not been able to end it and another that the various contracting interests intend to conclude to meet the immediate and urgent needs, which in their entirety are urgent, that must be speeded up in implementing them not in force.
