الملخص
ملخص: تسعى الدولة حاليا إلى إشباع الحاجات العامة للمواطنين المتعددة و المتطورة و المتزايدة بإستمرار عن طريق إنشاء المزيد من المرافق العامة المتنوعة التي تتم إدارتها و تسييرها عن طريق ما يسمى بإتفاقية تفويض المرفق المشكلة لعقد إداري يبرم بين السلطة المفوضة و المفوض له و الخاضع لعدد من المبادئ الحاكمة لإبرامه و تنفيذه ، و المتبع فيه الأشكال الأربعة للتفويض المتمثلة في الإمتياز و الإيجار و الوكالة المحفزة و كذا التسيير، و التي رغم إختلافها في الخصائص و المميزات إلا أنها تشترك في تحقيقها لهدف واحد و المتمثل في تطوير و ترقية و تحقيق فعالية الخدمة العمومية المقدمة من طرف المرافق العامة.
