تعديل الدستور وأثره على سلطات النظام السياسي: الجمهورية الفرنسية الخامسة نموذجاً

الملخص
ملخص: تحددت مشكلة الدراسة في التعرف على أثر تعديل دستور الجمهورية الفرنسية الخامسة على سلطات النظام السياسي الفرنسي. وقد هدفت الدراسة إلى التعرف على طبيعة النظام السياسي الفرنسي ومراحل تطوره وصولاً إلى الجمهورية الخامسة 1958، كذلك التعرف على دستور الجمهورية الفرنسية الخامسة وأهم تعديلاته وشكل سلطات النظام السياسي، وبالتالي تحليل أثر التعديلات الدستورية على هذه السلطات. استخدمت الدراسة المنهج التاريخي والمنهج الوصفي-التحليلي، وقد تحققت فرضية الدراسة التي مفادها: " ساهمت التعديلات على دستور الجمهورية الفرنسية الخامسة 1958 في ترجيح كفّتي الميزان لصالح السلطة التنفيذية (رئيس الجمهورية) على حساب باقي سلطات النظام السياسي الفرنسي" إيجاباً. توصلت الدراسة إلى عدة نتائج ابرزها: أن هناك دور لنوعية الأغلبية البرلمانية في الجمعية الوطنية في إظهار قوة رئيس الجمهورية وسطوته على مؤسسات الدولة. Abstract: The problem of the study was determined in identifying the effect of amending the constitution of the Fifth French Republic on the authorities of the French political system. The study aimed at identifying the nature of the French political system and its stages of development, reaching the Fifth Republic in 1958, as well as identifying the constitution of the Fifth French Republic, its most important amendments and the form of authorities of the political system, and thus analyzing the impact of constitutional amendments on these authorities. The study used the historical and descriptive-analytical method, and the study hypothesis was fulfilled that: “Amendments to the constitution of the Fifth French Republic 1958 contributed to favoring the two scales of the balance in favor of the executive authority (President of the Republic) at the expense of the rest of the authorities of the French political system” positively. the study reached several The most prominent results: that there is a role for the quality of the parliamentary majority in the National Assembly in showing the power of the President of the Republic and his control over state institutions.
