حق المتهم في الصمت

الملخص
انطلاقا من قرينة البراءة التي مفادها أن المتهم برئ حتى تثبت إدانته، تقررت عنها جملة من الحقوق تتمثل في "حقوق الدفاع" لتوفر للمتهم الضمانات الأساسية عند تعرضه لموقف اتهامي من قبل السلطات المختصة، هذه الحقوق تمنح للمتهم قدرا كبيرا من الشعور بالاطمئنان ضد الأعمال التعسفية، لأنه وبحسب الأصل غير ملزم بإثبات براءته، لأنها متأصلة فيه ونابعة من حريته الأساسية، وهذا ما يبرر حقه في التزام الصمت، أين يتخذ المتهم موقفا سلبيا في مواجهة الاتهامات الموجهة ضده كوسيلة للدفاع عن نفسه، حيث يستفيد منها سواء بصفته مشتبها فيه أو متهما، سواء كان مبتدئا أو عائدا، بالغا أو حدثا ومهما كانت جسامة الفعل المسند إليه، وذلك على امتداد مراحل الدعوى الجزائية، حيث يؤدي عدم احترام حقوق الدفاع ومنها الحق في التزام الصمت إلى بطلان الإجراءات. Out of the presumption of innocence which means that the accused is innocent until proven guilty results a set of rights, one of which is the right to defence which provides the accused with some fundamental rights after being charged by the competent authorities, these rights make the accused feel confident and immune against abusive acts, because it’s well-established that the accused is not bound to prove his innocence, and because innocence is derived from his essential freedom, and the hatter justifies his right to keep silent, which implies that he adopts a negative attitude in dealing with the accusations weighing upon him, as means to defend himself, Any person benefits from the presumption of innocence as a suspect of accused, either he is first offender or re-offender, major or minor, and nonetheless the gravity of the act lodged against him, this right shall be respected through the versions phases of the penal procedure, the non-oliservance of the right to defence, particularly the right to remain silent may lead to the nullity of the procedure.
