الملخص
الملخص تضمنت التشريعات الجزائرية، لا سيما القانون رقم 16-09 المتعلق بتطوير الاستثمار والنصوص التنظيمية المرتبطة به، عددا كبيرا من المحفزات منها إعفاءات ضريبية، تسهيلات للحصول على العقار الصناعي، تقليص الإجراءات، ضمانات قانونية ومالية وقضائية...كما تملك الجزائر بنية تحتية جسدتها الاف الكيلومترات من الطرق البرية والسكك الحديدية والعديد من الموانيء والمطارات. لكن من خلال تحليل النصوص القانونية ذات الصلة بالاستثمار بعد التعديل الدستوري لسنة 2016، ودراسة واقع الاستثمار الأجنبي في الجزائر، تبين لنا أن تطوير النظام القانوني وزيادة الامتيازات والضمانات لا تؤدي بشكل الي إلى انجذاب الاستثمار الأجنبي، بل يجب توفير مناخ استثماري متكامل يتضمن بيئة ملائمة توفر أكثر فرص للنجاح بعيدا عن الفساد الإداري والبيروقراطية، ونظام بنكي متطور، واجراءات بسيطة لإنجاز المشروع الاستثماري واستغلاله. كلمات مفتاحية: قانون، مقومات، معوقات، مناخ، الاستثمار. Abstract: Algerian legislation, in particular Law No. 16-09 on Investment Development and Related Regulatory Provisions, provided for a large number of incentives, including tax exemptions, facilities for obtaining industrial property, the reduction of procedures, legal, financial and judicial guarantees ... Algeria also has an infrastructure of several thousand kilometers of road, rail and many ports and airports. However, by analyzing the legal provisions relating to investments after the amendment of the 2016 Constitution and by studying the reality of foreign investment in Algeria, we found that the development of the legal system and the increase of privileges and guarantees do not lead to attracting foreign investment, but creating an integrated investment climate that includes a supportive environment. Most chances of succeeding far from administrative corruption and bureaucracy, a sophisticated banking system and simple procedures to carry out the investment and exploitation project.
