سِجْنُ اللُغَة وتَرجَمَةُ المُصطَلَحِ الإسلاميِّ الشَّرعِيّ Language Imprisonment And The Translation Of Islamic Legal Terminology

الملخص

مُلَخَّصُ: على كَثرَةِ ما كُتِبَ في إشكالاتِ تَرجَمَةِ المُصطَلَحِ الدِّينيِّ أَو الإسلاميِّ أَو الشَّرعيِّ، لَم أَجِدْ مَن نَظَرَ في كِتابَتِهِ في هذا المجالِ الحَسّاسِ مِن مَنظورِ مَفهومِ (سِجْن اللُغَة prison of language) الذي تَنَقَّلَ في حَواضِنَ مُختَلِفَةٍ؛ إذ يُمكِنُ تَلَمُّسُ جُذورِهِ الأُولى في فلسَفَةِ نيتشَه Nietzsche، قَبلَ أَن يَنبَعِثَ بِصيغَتِهِ المُتَطَرِّفَةِ في حَقلِ اللِسانِيّاتِ ولا سِيَّما فَرضِيَّةُ سابير ووورف the Sapir-Whorf Hypothesis، لِيَجِدَ حاضِنَتَهُ الأَخيرَةَ في الدِّراساتِ الإسلاميَّةِ الشَّرعيَّةِ التي نَهَضَ بِها، ولا يَزالُ يَنهَضُ، وائل حَلّاق الذي يُعَدُّ مِن أَهَمِّ دارِسِي الشَّريعَةِ الإسلاميَّةِ في الغَربِ. فعَزَمْتُ، بَعدَ التَّوَكُّلِ على اللهِ، أَن أُميطَ اللِثامَ عَن هذهِ المُفارَقَةِ الخَطيرَةِ التي لا تَزالُ مَسؤولَةً عَن تَشويهِ تَصَوُّراتِ الغَربِ لِكَثيرٍ مِن أَحكامِ الإسلامِ ومَواقِفِهِ المُتَشَنِّجَةِ مِنها. Abstract: Although there is an abundance of literature about the problems of translating religious, Islamic, or legal terms, I couldn't find any writer who looked into this sensitive field from the perspective of the (prison of language) which has wandered from one discipline to another; its first appearance being Nietzsche's philosophy; the second being the linguistic field and especially the Sapir-Whorf Hypothesis; and the third and last being Islamic legal studies the most prominent scholar on which in the western world is professor Wael Hallak. So, after depending on God, I intended to reveal this significant paradox which still is responsible of distorting many western conceptions and fanatic attitudes concerning Islam and its rulings.
