السند الصحيح كشرط لتملك العقار بالتقادم القصير في القانون الجزائري

الملخص
ملخص: تكتسب الملكية العقارية انتقالا من المالك الى الحائز بالتقادم، وهو إما تقادم طويل، يشترط فيه حيازة العقار حيازة قانونية صحيحة خالية من العيوب لمدة خمسة عشر سنة كاملة. وإما تقادم قصير، وهو الذي يشترط فيه الى جانب شرط الحيازة والمدة القانونية (عشر سنوات) وجوب ان تكون هذه الحيازة بحسن نية ومستندة في ذلك الى سند صحيح، ويعتبر السند الصحيح تصرفا قانونيا ناقلا للملكية عيبه الوحيد أنه صادر عن غير المالك الحقيقي للعقار محل الحيازة، وإن كان هذا السند لا يٌمَلك صاحبه العقار في الحال لأنه صادر عن غير المالك إلا أنه يمكنه من تملك العقار بالتقادم القصير تمييزًا وتفضيلاً له عن الحائز دون سند أو بسند غير صحيح. وهو ما يطرح التساؤل حول مدول هذا السند وما الشروط الواجب توافرها فيه لاعتباره سنداً صحيحاً والاثار المترتبة عليه. وتتلخص هذه الدراسة في وصف وتحليل أحكام السند الصحيح في القانون المدني الجزائري ومدى توافقها مع الأحكام الواردة بشأن الشهر العقاري. Abstract: Real estate ownership is acquired by a transfer from the owner to the statute-holder on either a long période prescription i.e. a correct légal possession without defects for a period of fifteen complete years, or a shorter one of ten full years in bona fide and correct légal possession. The disadvantage of this bond is that it was issued by someone other than the real owner of the property; although this method doesn’t transfer the property to the state holder automatically but he has the priority over others like the holder without legal basis… This leads us to question the significance of this possession title and the necessary needed conditions to accept it as a legal title of possession as well as its consequences. This study will concentrate on describing and analysing the bond legal provisions contained in the Algerian civil law and its compatibility with the provisions of the real estate registry.
