الوكيل الإلكتروني آلية حديثة للتعبير عن الإرادة

الملخص
سمح التطور التكنولوجي باستعمال وسائل إلكترونية حديثة للتعبير عن الإرادة في العقود، ومن بين أهم هذه الوسائل؛ الوكيل الإلكتروني (الوكيل الذكي)، الذي تناولته أغلب التشريعات الوطنية والدولية في نصوصها القانونية، مانحة إياه أهلية تمثيل المتعاقدين، بسبب قدرته على التعامل بصورة سريعة ودقيقة وفق برمجة مسبقة، مقارنة بباقي التقنيات الأخرى. وقد اشتمل هذا البحث على محورين، تناول الأول، حقيقة الوكيل الإلكتروني، فتم بحث الوكيل الإلكتروني دراسة تفصيلية، تبين كل ما يتعلق به من تعريف، وتبيان لخصائصه، ثم تحديد طبيعته القانونية لمعرفة مدى تحمله للمسؤولية في حال وقوع الخطأ. أمّا المحور الثاني، ففيه بيان لمدى صلاحية الوكيل الإلكتروني للتعبير عن الإرادة، وضحنا من خلاله أن التعبير عن الإرادة بواسطة الوكيل الإلكتروني يتم عن طريق رسالة البيانات، ويتم وفق ما يعرف بالإيجاب الإلكتروني، والقبول الإلكتروني، إلى جانب بحث الخصائص التي تميزهما عن الإيجاب والقبول الكلاسيكيين، ومدى صلاحية السكوت للتعبير عن الإرادة. ثم بحثنا نطاق الوكيل الإلكتروني في التعبير عن الإرادة، في إشارة إلى احتكار التعبير عن الإرادة الكلاسيكي لبعض التصرفات، إلى جانب بعض الاستثناءات التي تطلبها نوعية المعاملة المقصودة. وفي الأخير توصلنا إلى خاتمة لخصت جملة النتائج التي خلصنا إليها من خلال هذا البحث. The technological development allowed the use of modern electronic means to express the will in contracts. Among the most important of these means: the electronic agent (smart agent), dealt with by most national and international legislations in their legal texts granting it the capacity to represent contractors, because of its ability to deal quickly with accuracy according to pre-programming; in comparison with the other techniques. This research included two axes: the first dealt with: how to express the will through electronic agent, which is carried out through the electronic consent, and electronic acceptance, as well as research of the features and characteristics that distinguish them from classic consent and acceptance. As for the second axis: a research has been performed concerning the electronic agent, a detailed study that shows all that relates to it, defining the data message that contains to express the will, determine its legal nature to know the extent of its responsibility in case of an error, then shows how the electronic agent is able to express the contractor's satisfaction, referring to the monopoly of the expression of the classic will of some behaviors. Finally, we reached to a conclusion summarizing the total results reached through this research.
