الملخص

الملخص: هدفت هذه الدراسة إلى بيان مفهوم الإكراه ، وشروطه وحالاته ، مع الوقوف على أثر الإكراه في بعض المعاملات ، وقد اختار الباحث ثلاثاً من أهم المعاملات المرتبطة بالمكلف وهي : البيع والنكاح والطلاق . اتبعت الدراسة المنهج الاستقرائي التحليلي المقارن . توصلت الدراسة لعدة نتائج منها : الإكراه عارض من عوارض الأهلية المكتسبة ، وهو لا يسقط التكليف بالكلية ولكن يقتصر تأثيره على بعض الأحكام . للإكراه شروط لابد من توافرها حتى ينتج أثره . Abstract This study aimed at clarifying the concept of compulsion, its conditions and situations, also to study the impact of compulsion on some dealings, the research chosen three important dealings that are associated with the settlor which are, selling and buying, marriage and divorce. The researcher used extrapolated analysis comparative method. The researcher reached to many finding some are: Compulsion is one of the types of obtained legitimacy, it mandatory does not fall in complete but it is specialized on its impact on some judgements. For compulsion have condition that should be available for it to have an impact.
